However, please be advised that for the safety and protection of everyone, all visitors must first agree to all of our terms and conditions as stated in this membership agreement below (hereinafter referred to interchangeably as the “Agreement”, the “Membership Agreement”, and/or the “Terms and Conditions”):
1. ABOUT US:
Rent2Film.com (hereinafter referred to as “Rent2Film”), is a subsidiary of Aleco Entertainment, Inc., a California Corporation and has no vested interests in any of the properties listed in this web site and is not in any way affiliated with any film production company or affiliates thereof.

2. STATEMENT OF INTENT:
This web site is designed to help create a marketplace where property owners can showcase their properties for filming purposes to movie and photo production companies (hereinafter referred to as the “Members”). We do not guarantee, however, that a user will find an acceptable location and/or that a location property will be chosen for filming.
3. TRADEMARK & COPYRIGHT:
(a) Aleco Entertainment, Inc. and Rent2Film collectively and individually own the exclusive copyright for any and all material, logos, names, trademarks, images, and all illustrations on the web site.
(b) Each Member may download only one copy of online material for non-commercial personal use only, provided the Member also keep all copyright notices contained regarding on the materials. Members may not, however, copy, reproduce, republish, upload, post, transmit or distribute the online, including text, logos, images, or trademarks in any way without prior written consent of Aleco Entertainment, Inc. and/or Rent2Film.
(c) Any unauthorized attempts to modify the online material, to defeat or circumvent our security features, or to use the Rent2Film web site for other than their intended use is strictly prohibited.
(d) Once you agree to the Terms and Conditions and become a Member, you agree to not share, sell, transfer or disclose your password or the site’s content to third parties or for any unauthorized purpose. If you do, your rights will be terminated and you will be held accountable for any and all resulting damages and/or consequences.
4. SUBMISSIONS BY MEMBERS:
(a) Any and all communication or material, including data, questions, comments, postings, digital images, products, materials, or suggestions you transmit to Rent2Film and its web site by electronic mail or posted on the producers forum otherwise, will become the exclusive property of Rent2Film and Aleco Entertainment, Inc. and Rent2Film and Aleco Entertainment, Inc. will have the exclusive, perpetual right to use said materials for any future purpose including, but not limited to, developing, manufacturing, marketing, promotion, brochures, internet, commercials, infomercials, videotapes, online advertising, magazines, newspapers, all in conjunction with the promotion of the undersigned property. No submission will be subject to any obligation of confidence by Rent2Film and Aleco Entertainment, Inc., and neither Rent2Film nor Aleco Entertainment, Inc. will be liable for any use or disclosure of any submission. Rent2Film and Aleco Entertainment, Inc. will exclusively own all known or later-existing rights to the submission worldwide, and will be entitled to the unrestricted use of the submission for any purpose without compensation of any kind to the provider/member of the submission.
5. LIMITATION OF LIABILITY:
(a) A Member’s use of, and/or browsing in, or submitting digital images to, the Rent2Film website or producer’s forum are at Members own risk. Rent2Film and Aleco Entertainment, Inc. and its officers, partners, contractors, employees, or any other party involved in creating, producing, or delivering the Rent2Film websites and producers forum are not liable for any direct, indirect, special, incidental, consequential, or punitive damages whether physical, personal, property and/or monetary related damage(s), arising out of your access to, or inability to access or use the Rent2Film and producer’s forum. Once a Member and/or once you have used this site, all actions taken and all contracts entered into, are at your own risk. Rent2Film and Aleco Entertainment, Inc. also assume no responsibility, and shall not be liable for, any damages to the Member’s computer, or viruses, worms, Trojan horses, or other codes that may infect the Member’s computer equipment or other property on account of the Member’s access to, use of, or browsing in the Rent2Film website or your downloading of any materials, data, text, images, from the Rent2Film web site and producers forum.
(b) Furthermore, all Members are aware that they have voluntarily chosen to become Members of Rent2Film. It is the sole responsibility of all Members or individuals deciding to become a Member (and of their successors and assigns), to do their own due diligence, including but not limited to seeking the advice of their legal counsel or accountant at their own expense and preference, prior to becoming a Member of Rent2Film or prior to entering into any contracts as a result of their membership in Rent2Film.
(c) Finally, although Rent2Film reserves the right to from time to time monitor and/or review postings, e-mails or other transmissions to its website, Rent2Film and/or Aleco Entertainment, Inc. is under no obligation to do so and assumes no responsibility or liability arising from the content or for any error, defamation, libel, slander, omission, falsehood, obscenity, pornographic, illegal, or profane material, or material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law. Rent2Film and/or Aleco Entertainment, Inc. reserve the right to delete or edit any postings that do not, in our sole discretion, meet the Terms & Conditions of this web site. Should you discover any errors or inaccuracies, please contact us to report them.
6. POSTINGS:
(a) Members are solely and fully responsible for any content that the Member’s post on producer’s forum on the Rent2Film website. Rent2Film does not at anytime allow material or links to material that is threatening, abusive, harassing, defamatory, obscene, vulgar, profane, or pornographic. Profanities, posting of other people’s private information, and/or postings that violate copyright law are not permitted. Rent2Film reserves the right to delete or edit, as it sees fit, any postings that do not, in Rent2Film’s sole discretion, meet these Terms and Conditions.
(b) Members are not allowed to post the name of any business establishment, or include images which show and/or depict the names of any business establishments, on the Rent2Film website at any time.
(c) Rent2Film will immediately and without any notice terminate the membership of any user who violates these Terms and Conditions of Rent2Film.
(d) You agree to indemnify, protect, defend and hold harmless Rent2Film and its owners, officers, and employees from any claim, demand or damages, including attorney’s fees, made by any third party for any matter arising out of, or relating to, your use of the site or location negotiations.
7. INSURANCE:
All Members during the term of their membership in Rent2Film must, at their own cost and expense, procure and maintain, during the continuance of their membership, a policy of liability insurance and must, on demand, deposit with Rent2Film a certificate evidencing the policy. Both the property owner and the production side should do their own due diligence to make sure there is proper insurance to cover all parties before fully executing a contract. Rent2Film is to be held harmless in the event of lack of insurance coverage for property damage, and with respect to any and all liabilities, including personal and/or property related damage.
8. OWNERSHIP OF PROPERTY:
(a) All Members must be the legal owner of the property which they desire to post on Rent2Film and warrant that they have full legal authority to enter into contract, and can on demand produce the required documents evidencing title to the property in question.
(b) In the event a Member wishes to list his or her leasehold interest (i.e. rental property) the Member must first produce written document evidencing the owner’s consent and permission to list the property in question in Rent2Film.
9. WARRANTIES BY RENT2FILM:
(a) Rent2Film makes absolutely no representations and/or warranties, whether express or implied, regarding the completeness, accuracy, reliability, suitability, or availability with respect to its website and does not verify, endorse, warrant or vouch for the contents contained in any and all postings contained within its website. Any reliance you place on said information is strictly at your own risk. Both property owners and producers are to do their own due diligence and background check on the opposing party prior to executing a contract.
(b) Furthermore, Rent2Film has not and does not in any express or implied way guarantee any results or make any promises to any Member.
10. LISTING AGREEMENT:
Please be advised that this is a membership only website and only Members may submit postings in Rent2Film.
Your membership shall continue until we terminate your membership with or without cause, and/or you cancel your membership by sending us an email to support@rent2film.com. Until your membership is officially recognized as cancelled by us, you shall be accountable under these Terms and Conditions.
11. NEGOTIATIONS BY MEMBERS:
At no time will Rent2Film and/or Aleco Entertainment, Inc. be involved in, or be required to be involved in, any negotiations between any of its Members or between any of its Members and third parties.
12. WEB SITE CONTENT:
Rent2Film reserves the right to, at its own discretion, edit, delete, and/or add to any content on its web site at any time without prior notice to users and Members.
13. CHILDREN UNDER 18:
No children under the age of 18 should submit digital images to Rent2Film and no child under the age of 18 is allowed to become a Member.
14. ATTORNEYS FEES:
If any legal action or proceeding arising out of or relating to this Membership Agreement is brought by either party to this Membership Agreement, the prevailing party will be entitled to receive from the other party, in addition to any other relief that may be granted, the reasonable attorneys’ fees, costs, and expenses incurred in the action or proceeding by the prevailing party.
Any claim brought under this Agreement shall be filed as an arbitration proceeding in Los Angeles County.
15. CONTROLLING AGREEMENT:
In the event of any conflict between the provisions of this Agreement and the provisions contained in any other contract or agreement, the provisions of this Agreement shall control.
16. ENTIRE AGREEMENT:
This Membership Agreement contains all of the agreements, understandings, representations, conditions, warranties, and covenants made between the parties hereto.
17. NO IMPLIED WAIVER:
The failure of either party at any time to require performance by the other party of any provision hereof shall not affect in any way the full right to require such performance at any time thereafter. Nor shall the waiver by either party of a breach of any provision hereof be taken or held to be a waiver of the provision itself.
18. CONTROLLING LAW:
The validity, interpretation, and performance of this Agreement shall be controlled by and construed under the laws of the State of California.
19. PARTIAL INVALIDITY:
If any provision in this Agreement is held by any court or arbitrator to be invalid, void, or unreasonable, the remaining provisions shall nevertheless continue in full force.
20. REVISION OF TERMS & CONDITIONS:
Rent2Film may at any time revise the Terms and Conditions set forth herein by updating its postings without prior notice to its Members.
21. USE OF RENT2FILM.COM:
All Rent2Film services, including, but not limited to, this web site and the membership services are provided on an “AS IS” basis without any warranties of any kind, either express, implied, constructive or statutory, including without limitation, any implied warranties of merchantability, infringement or fitness for a particular purpose.
22. COUNTERPARTS:
(a) This Agreement may be executed and delivered in any number of counterparts, each of which so executed and delivered shall be deemed to be an original and all of which shall constitute one and the same instrument.
(b) A photostatic copy or other reproduction of this Agreement shall be sufficient for any and all purposes.
23. ASSIGNMENT:
The parties herein may not assign this Agreement without the written consent of the other party. However, said consent to assignment shall not be unreasonably withheld.
24. NO PARTNERSHIP:
Nothing contained in this Agreement shall be construed to create a partnership or joint venture between the parties or their successors in interest.
